Suspension, Termination and Cancellation 6.1
We may, at our sole discretion and without prejudice to any of our rights and remedies and without any liability to you, we may limit, suspend or permanently withdraw your access of our services, cancel any product(s) order and/or remove hosted content submitted by you for any reason including, without limitation, the following:

6.1.1 if we believe that you have infringed, breached, violated, abused, or unethically manipulated or exploited any term of these Terms of Use;

6.1.2 If you use our Platform or services for any unlawful and fraudulent purposes or in connection with a criminal offence or abuse our policy and rules;

6.1.3 You are suspected of inventory abuse or placing bulk order. The following shall (without limitation) constitute inventory abuse or placing bulk order:

6.1.3.1 Products ordered are not for self-consumption but for commercial resale;

6.1.3.2 Multiple orders placed for same product at the same address, depending on the product category;

6.1.4 Bulk quantity of the same product ordered;

6.1.5 Invalid address given in order details;

6.1.6 Any abuse or fraud used to place the order; or
-
6.1.7 Any order placed using a technological glitch/loophole.
6.2
We reserve our right to take appropriate action if you are suspected of acting fraudulently or if you file invalid and/or false claims or provides false, incomplete, or misleading information. You may be engaging in fraudulent activities if any of the following (without limitation) are met:

you don’t reply to the payment verification mail sent by us;

you fail to produce adequate documents during the payment details verification;

you misuse credentials not belonging to you;

you use invalid address, email and phone no;

you attempt to overuse a voucher code;

you return wrong or damaged product;

you refuse to pay for an order;

you use fake currency notes to make the payment;

you abuse or harass the delivery staff;

miscellaneous activities conducted with the sole intention to cause loss to business/revenue to MU Express;

your return, undeliverable rate is very high and often the returned products are missing, fake or damaged; or

Repeated request for monetary compensation.
6.3
If your access to our services or our Platform is terminated for any reason, we may delete any content or other materials relating to your use of the Service (including any credits earned through loyalty programs or reward points) and we will have no liability to you or any third party for doing so. However, your transactions details may be preserved by us for purposes of tax or regulatory compliance.
6.4
For the avoidance of doubt, any amounts paid and received by us in relation to a cancelled product(s) order will be refunded.
Advertising and Sponsorship 7.1
Some areas within the muexpress.mv site may contain advertising and sponsorship. Third party advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the muexpress.mv site complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material provided by third parties.
Availability of the MU Express site 8.1
muexpress.mv aims to offer a fault-free service. However, if a fault occurs in the service, you should report it to the customer services mentioned herein or by email at sales@muexpress.mv and we will attempt to correct the fault as soon as we reasonably can.

8.2 muexpress.mv site may occasionally restrict access to the site to allow for repairs, maintenance or the introduction of new facilities or services.

Descriptions and prices of products 9.1
We have taken care to describe and show products as accurately as possible. Despite this, products may vary from their descriptions, product images are for representation purposes only and may vary slightly from the actual product. If there is anything that you do not understand, or if you wish to obtain further information, please contact customer services Descriptions/performances of products stated against each are based on the catalogue and technical literature printed by the manufacturers/agent. Therefore, the write up provided against each product is not that of muexpress.mv and subject to change without prior notice.
9.2
Price may sometimes differ between MU Express outlet and muexpress.mv; you will be charged the price on the muexpress.mv upon use of this site. We are under no obligation to honour any in-store price or promotion in the event that it differs from those on the MU Express site.
9.3
If, by mistake, we have under-priced a product, we will not be liable to supply that product to you at the stated price, provided that we notify you before we dispatch the product to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the product at that price. If you decide not to order the product, we will give you a full refund on any amount already paid for that product in accordance with our refund policy.
9.4
The payment may be processed prior to muexpress.mv dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit card account. No cash disbursement shall be made under any condition whatsoever.
9.5
The price of a product does not include the delivery charge, which will depend on the delivery method you choose and will be added during checkout.
Availability 10.1
All products advertised are subject to availability or while stocks last (as may be applicable).
10.2
We try to ensure that we always stock the full product range and will let you know if the product is out of stock. If for any reason beyond our reasonable control we are unable to supply a particular product, we will not be liable to you except to ensure that you are not charged for that product.
10.3
In the interests of all our customers, we may place restrictions on bulk buying of some products. Muexpress.mv reserves the right at our sole discretion, to limit the quantity per person, per household or per order. The said limitations may be applicable to orders placed by the same account, the same credit card and also to orders that use the same billing and/or shipping address. MU Express site will provide notification to the customer should such limits be applied.
Acceptance of Orders 11.1
Your order is an offer to buy from us. We will send you an order acknowledgement email detailing the products you have ordered.
11.2
Nothing that we do or say will amount to any acceptance of your offer until we send you an email notifying you of the order acknowledgment. At this point, a contract will be made between us for you to buy and for us to sell the products that you have ordered from us.
11.3
After the time the contract is made, you cannot amend your order.
11.4
At any point up until the contract is made, we may decline to supply a product to you. If we decline to supply a product to you and you have already paid for it, we will give you a full refund of any amount already paid for that product in accordance with our refund policy.
Deliveries 12.1
Delivery will be made to the address specified when you complete the order. At point of delivery, identity verification of the Consignee by sighting either an original ID card, passport, driving license, or work permit ID to support consignee verification, will be required by our delivery partners.
12.2
Please note that we do not do international shipping.
12.3
We use a variety of delivery methods, depending on the size of the product you order. Some products are delivered directly by our supplier and the supplier will contact you to arrange delivery.
12.4
Whilst we make considerable effort to deliver all your products within 24 working hours of the date of your order, we shall not be liable if we fail to do so in part or in full due to circumstances beyond our control. We shall contact you to let you know if we are having any problems getting a product to you within that time. Deliveries outside of main city that are classed as remote or semi remote may take up to 5 working days dependant on boat schedules.
12.5
Before ordering online you should check the following:

12.5.2 The item will fit the exact space allocated in your house.

12.5.3 There is a clear path between the road and your front door.

12.5.4 If you live in an apartment, the lift is adequate to take delivery in size and weight.

12.5.5 If there are any access difficulties, please inform us in advance, on the day you should ensure that:

12.5.5.2 Your floors are covered to prevent scuffing.

12.5.5.3 Any delicate objects are put in a safe place.
Cancelling your order if you change your mind 13.1
If you the customer cancel the order, MU Express site shall cancel the order as per your request. However, the online transaction charges will not be refunded. Muexpress.mv will not be able to cancel orders that have already been shipped. MU Express site has the full right to demonstrate whether an order has been shipped or not. The customer agrees not to dispute the decision made by muexpress.mv and accept muexpress.mv decision regarding the cancellation.
Faulty Products 14.1
If your products arrive damaged or they are faulty, you may return them and obtain a refund or replacement product.
Refunds On MU Express site 15.1
If you are entitled to a refund, we will refund you according to the following criteria:

muexpress.mv is unable to procure products: a reasonable time of 7-10 days from the date of authorization must be given.

15.1.2
Products are not working upon delivery.

15.1.3
Products are lost in deliveries.

15.1.4
Product cannot be repaired.

15.1.5
Refunds for products purchased under a promotional offer will be based on the terms of the promotional price.

15.1.6
Refund settlement will only be affected once the bank has refunded the money, which is the next billing cycle from the date of application of refund.

15.1.7
Please keep all items with their complete packaging and inside packaging intact if you intend to refund any items within the conditions set out. No exchange or refund will be considered without it.

15.1.8
If the purchased product is past its expiry date.
15.2 Exclusion from Exchange/Return
Due to hygienic reasons, no exchange, return or refund will be offered on lingerie, cosmetics, perfumes, and personal grooming products, like shavers, trimmers, and epilators.

15.2.1
For frozen foods, chilled and dairy products on which temperature inconsistencies can happen, we do not provide any exchange, return and refund once sold and taken out from the store (be the case of a purchase made on the same day with the limited time as well temperature).

15.2.2
Products damaged while being used do not qualify for repair, exchange or refund, in reference to physical damage.
15.3 Exchange/Returns Policy – Fresh Food Category
Sections in the department:

15.3.1 As a rule, there is no exchange and return on fresh food items once sold and taken out from the store.

15.3.2 On perishables, there is no exchange and refund. However, if it is spoilt at the time of purchase, an exchange could be provided.

15.3.3 If the customer has purchased a wrong product and is returning the same immediately after the purchase, an exchange note could be considered. An item which is past its expiry date qualifies for exchange.

15.3.4 If the product is not of the quality expected, the same can be returned within the same day of purchase and an exchange note could be issued. Exchange could be considered, as long as it is supported by the original receipt or invoice.

15.3.5 If the customer insists for return, customer service supervisor can always contact the supervisor concerned for further assistance.

15.3.6 Item returned should not be mixed with the normal items and should be disposed immediately.

15.3.7 Exchange voucher, credit note, and refund could be used as a last resort to retain the customer and prevent churn.

15.3.8 All product exchanges, product returns and exchange voucher/credit notes should have the approval and signature of manager on duty.
15.4 Procedures for issuing and Exchange Voucher / Credit Note.

15.4.1 Customer must present the original invoice (bill) at the customer service desk.

15.4.2 In normal return process, an exchange voucher/customer tax credit note can be issued with the consent and approval of the Team Leader, and the Manager on duty.

15.4.2 It is mandatory to fill the following details on the Customer “Tax Credit Note”:

15.4.2.1 Customer Name & Mobile number

15.4.2.2 Name and Signature of Section staff/Section Supervisor, and Duty Manager.

15.4.3 All approvals must be done on the spot of customer return by verifying the product and should not be done at the end of the day.

15.4.4 This approved Customer Tax Credit Note must be retained at the Customer Service desk always and handed over to the Office at End of Day Operations.
Payments and Cards 16.1

16.2 Your credit/debit card details will be encrypted to the highest standard and held on the Cyber source Host payment gateway, secure from hackers.

16.3 When ordering from the muexpress.mv, we accept orders only from web browsers that permit communication through Secure Socket Lawyer (SSL) technology.

16.4 All customers will be charged in local currency relating to the country of order. If a foreign currency credit card is used, then any differences between approximation in any foreign currency and actual billing price on the customer’s card bill statement is probably attributable to different credit card companies charging different exchange rates.

16.5 All customers are recommended to retain a copy of the transaction record and payment for reference if the need may arise at some point.
Amendments 17.1
We may update these Terms & Conditions from time to time and any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the MU Express site. The changes will apply to the use of the MU Express site after we have given notice. If you do not wish to accept the new Terms and Conditions, you should not continue to use the muexpress.mv site (including purchasing any products on the muexpress.mv site). If you continue to use the muexprss.mv site after the date on which the change comes into effect, your use of the muexpress.mv site indicates your agreement to be bound by the new Terms and Conditions.
Right To Suspend or Close your Account 18.1
We may suspend or close your account immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions. You will not be able to order products on the MU Express site if your account is suspended or closed.
Our Responsibility to You 19.1
The MU Express site is provided by Relax Travel & Tours Pvt Ltd without any warranties or guarantees.
19.2
The MU Express site may provide content from other internet sites or resources and while muexpress.mv tries to ensure that material included on the muexpress.mv site is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. Muexpress.mv will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems, you may experience with the muexpress.mv site. If MU Express site is informed of any inaccuracies in the material on the muexpress.mv site, we will attempt to correct the inaccuracies as soon as we reasonably can.
19.3
In particular, we disclaim all liabilities in connection with the following:

19.3.1 Incompatibility of the muexpss.mv site with any of your equipment, software or telecommunications links; and

19.3.2 Technical problems including errors or interruptions of the MU Express site.
19.4
If we are in breach of these Terms and Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you order the relevant product or the time you otherwise use the muexpress.mv site.
19.5
Because we sell products for personal use only, our responsibility to you shall not include any business losses, such as lost data, lost profits, lost sales or business interruption.
Miscellaneous 20.1
You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.
20.2
If you breach these Terms and Conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms and Conditions.
20.3
Neither party shall be responsible for any breach of these Terms and Conditions, caused by circumstances beyond that party's control.
20.4
Except as expressly set out in these Terms and Conditions, all use of your personal information will be made in accordance with our Privacy and Cookies Policy.
20.5
All customers and clients are recommended to retain a copy of these terms and conditions.
Governing Law 21.1
These terms and conditions shall be governed by and construed in accordance with the laws of the Maldives, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of the Maldives.
